Accommodation Terms and Conditions

These Accommodation Terms and Conditions ("Terms") apply to accommodation contracts and related agreements entered into with accommodation facilities operated under the Section L, Monograph Hotels and VOL. brands (each a "Hotel" and collectively, the "Hotels").

The Hotels are operated and/or managed by K.K. Section L (株式会社セクションL) (the "Company", "we", "us" or "our").

These Terms apply to all participating Hotels unless otherwise specified by the relevant Hotel, accommodation plan, reservation conditions or other individual agreement.

01 Scope of Application

Accommodation contracts and related agreements entered into between a Hotel and a Guest shall be governed by these Terms.

Use of websites, applications and other digital platforms operated by the Company is separately governed by the applicable Website Terms of Use.

In relation to an accommodation reservation or stay, where there is any inconsistency between these Terms and the Website Terms of Use, these Accommodation Terms and any specific conditions applicable to the relevant reservation shall govern the accommodation contract.

Matters not stipulated in these Terms shall be governed by applicable laws and regulations and generally accepted practices in Japan.

Where a Hotel enters into a special agreement with a Guest, including conditions applicable to a particular Hotel, accommodation plan, promotion, rate or reservation, such special agreement shall take precedence over these Terms to the extent permitted by applicable laws and regulations.

02 Application for an Accommodation Contract

A person applying for accommodation shall provide the information reasonably requested by the Hotel, which may include:

  1. name of the Guest(s);
  2. accommodation date(s) and expected arrival time;
  3. number of Guests;
  4. address and contact information;
  5. accommodation plan, room type and applicable accommodation charges;
  6. information required under applicable laws and regulations; and
  7. any other information reasonably required in connection with the reservation or stay.

Where a Guest requests an extension of the accommodation period beyond the dates originally reserved, the Hotel may treat such request as a new application for an accommodation contract.

Individual Hotels, accommodation plans, promotional rates, member rates and special offers may be subject to additional terms and conditions presented at the time of booking.

03 Conclusion of the Accommodation Contract

An accommodation contract shall be concluded when the Hotel accepts the Guest's application for accommodation and a booking confirmation is issued to the Guest.

The submission of a reservation request through a website, application or other booking channel does not by itself constitute acceptance of the reservation.

Acceptance may be communicated through a booking confirmation issued directly by the Hotel or Company, or through an authorised reservation platform, travel agent or other booking channel.

Where advance payment, a deposit or a valid payment method is required as a condition of the reservation, confirmation of the reservation may be subject to completion of such payment or payment authorisation within the period specified.

Guests are responsible for reviewing their booking confirmation and notifying the Hotel promptly of any errors or discrepancies.

04 Accommodation Charges and Payment

Guests shall pay the accommodation charges and any additional charges applicable to their reservation.

Accommodation charges shall be based on the rates displayed or otherwise communicated at the time the reservation is made.

Applicable taxes and mandatory charges shall be presented or collected in accordance with applicable laws and regulations.

Payment shall be made using a payment method accepted by the relevant Hotel.

The Hotel may require full or partial advance payment, a valid credit card guarantee or other payment security depending on the accommodation plan or reservation conditions.

Additional charges incurred during the Guest's stay shall be payable no later than check-out unless otherwise agreed.

Where a reservation is made through a third-party booking platform or travel agent, the payment and refund conditions applicable to that reservation may also apply.

05 Refusal to Conclude an Accommodation Contract

The Hotel may refuse to conclude an accommodation contract where permitted under applicable laws and regulations, including where:

  1. The application for accommodation does not comply with these Terms;
  2. There are no rooms available;
  3. The person seeking accommodation falls within circumstances for which refusal of accommodation is permitted under the Hotel Business Act of Japan or other applicable laws and regulations;
  4. Accommodation cannot be provided due to natural disaster, failure of facilities, infrastructure disruption or other unavoidable circumstances;
  5. The person seeking accommodation engages in conduct prohibited by applicable laws and regulations;
  6. The person seeking accommodation makes demands or engages in conduct falling within circumstances for which refusal is permitted under the Hotel Business Act and its related regulations; or
  7. The Hotel is otherwise permitted or required by applicable laws and regulations to refuse accommodation.

06 Guest's Right to Cancel a Reservation

A Guest may cancel an accommodation contract in accordance with the cancellation conditions applicable to the reservation.

Cancellation charges may apply as communicated to the Guest at the time of booking.

Where a particular Hotel, accommodation plan, promotional offer, discounted rate or other booking condition has its own cancellation or refund policy, that policy shall apply.

Where a reservation has been made through a third-party booking platform or travel agent, cancellation may be required through that provider and shall be subject to the applicable booking conditions.

07 Cancellation Charges and No-Shows

If a Guest cancels an accommodation contract, the Hotel may charge a cancellation fee in accordance with the cancellation conditions applicable to the reservation.

Unless otherwise specified at the time of booking, the standard cancellation policy established by the relevant Hotel shall apply.

If a Guest does not arrive by the expected arrival time and does not contact the Hotel, the Hotel may treat the reservation as a cancellation or no-show in accordance with the applicable reservation conditions.

Different cancellation conditions may apply to group reservations, long stays, promotional offers, advance-purchase rates and other special accommodation plans.

08 Hotel's Right to Cancel or Terminate an Accommodation Contract

The Hotel may cancel or terminate an accommodation contract where permitted under applicable laws and regulations, including where:

  • the Guest falls within circumstances for which accommodation may lawfully be refused;
  • the Guest provides materially false or misleading information in connection with the reservation or guest registration;
  • the Guest fails to make payment when required under the accommodation contract;
  • the Guest materially or repeatedly violates these Terms or the applicable Hotel's House Rules;
  • the Guest engages in conduct that materially disturbs other Guests, neighbouring residents, Hotel employees or other persons;
  • the Guest uses the accommodation for unlawful purposes;
  • the Guest causes or threatens serious damage to the Hotel, its facilities or equipment;
  • accommodation cannot be provided due to natural disaster, failure of facilities, government order or other unavoidable circumstances; or
  • termination is otherwise permitted under applicable laws and regulations.

Where an accommodation contract is terminated, the Guest may be required to leave the Hotel. Charges and refunds, if any, shall be determined in accordance with applicable laws, the circumstances of termination and the conditions applicable to the reservation.

09 Guest Registration and Identification

Guests shall provide the information required under applicable Japanese laws and regulations and any other information reasonably required for the lawful operation of the Hotel.

Guest registration may be completed before or at check-in, including through an online or digital check-in system where available.

Guests who do not have an address in Japan may be required under applicable Japanese laws and regulations to present their passport and provide information required for the guest register.

The Hotel may request identification where reasonably necessary for guest registration, identity verification, security or compliance with applicable laws and regulations.

Guests are responsible for ensuring that the information they provide is accurate and complete.

10 Check-in and Check-out

Check-in and check-out times vary by Hotel and shall be as specified on the relevant Hotel's website, booking page or reservation confirmation.

Early check-in and late check-out are subject to availability and may incur additional charges.

Guests shall vacate their room by the designated check-out time unless an extension has been approved by the Hotel.

Where a Guest remains in the room beyond the designated check-out time without prior approval, additional charges may apply.

11 Use and Occupancy of Guest Rooms

Guest rooms may be occupied only by the number of Guests registered and permitted under the reservation.

Guests shall not allow unregistered persons to stay overnight without prior approval from the Hotel.

Guest rooms shall be used solely for lawful accommodation and ordinary activities associated with the Guest's stay.

Rooms shall not be used for commercial activities, events, parties, commercial photography or filming, or other purposes outside ordinary accommodation without prior approval from the Hotel.

Maximum occupancy limits for each room must be observed.

Guests shall use all facilities, appliances and equipment provided in their room or Hotel safely and in accordance with any instructions provided.

12 House Rules

Guests shall comply with the House Rules established by the relevant Hotel.

House Rules may vary between brands and properties according to the facilities, services and characteristics of each Hotel.

Applicable House Rules may be made available through the relevant brand or Hotel website, booking confirmation, guest room, digital guest information or other appropriate means.

House Rules may include requirements concerning noise, smoking, visitors, room occupancy, parties and gatherings, use of facilities and appliances, waste disposal, fire safety, pets, prohibited items, security and other matters necessary for the safe and comfortable operation of the Hotel.

Serious or repeated violation of the applicable House Rules may result in termination of the accommodation contract where permitted by applicable laws and regulations.

13 Access to Guest Rooms

The Hotel respects Guests' privacy during their stay.

Hotel employees, contractors or authorized representatives may enter a guest room where reasonably necessary for housekeeping, maintenance, inspection, repairs, emergencies, safety or security, investigation of a serious violation of these Terms or the House Rules, or compliance with applicable laws and regulations.

Where reasonably practicable, notice will be provided before entering an occupied room, except in emergencies or circumstances requiring immediate action.

14 Responsibilities of the Hotel

The Hotel shall provide accommodation and related services in accordance with the accommodation contract and applicable laws and regulations.

If the Hotel causes loss or damage to a Guest through a breach of the accommodation contract or through an act or omission for which it is legally responsible, the Hotel shall compensate the Guest to the extent required by applicable law.

The Hotel shall not be responsible for loss or damage arising from circumstances beyond its reasonable control, except where liability is imposed by applicable law.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under Japanese law.

15 Responsibilities of Guests

Guests shall use guest rooms, furnishings, appliances, facilities and other Hotel property with reasonable care.

Where a Guest intentionally or negligently causes loss or damage to Hotel property, facilities or equipment, the Hotel may require the Guest to compensate for the resulting loss or damage to the extent permitted by applicable law.

Guests shall immediately notify the Hotel of significant damage, malfunction, accident, water leakage, fire, loss of access devices or other circumstances that may affect the safety or operation of the Hotel.

16 Guest Property and Lost Items

Guests are responsible for appropriately safeguarding their personal belongings during their stay.

Property left behind shall be handled in accordance with applicable laws and the relevant Hotel's lost-property procedures.

Where the owner can be identified, the Hotel may contact the Guest using the contact information provided in connection with the reservation.

Shipping, packaging or other costs associated with returning lost property may be charged to the Guest.

Items that cannot reasonably be stored due to their nature, including perishable, hazardous or unsanitary items, may be handled or disposed of as permitted by applicable laws and regulations.

17 Keys and Access Devices

Guests shall appropriately safeguard physical keys, key cards, access codes, digital keys or other means of accessing the Hotel or guest room.

Guests shall not provide access to unauthorized persons.

Lost or damaged keys or access devices must be reported to the Hotel immediately.

Reasonable replacement or security-related costs resulting from loss or damage caused intentionally or negligently by the Guest may be charged to the Guest to the extent permitted by applicable law.

18 Internet and Wi-Fi Services

Where internet or Wi-Fi access is provided, such access is provided as an ancillary service to accommodation.

Guests shall not use the Hotel's internet connection for unlawful activities, infringement of third-party rights, unauthorized access or activities that may compromise the security or operation of the network.

The Hotel does not guarantee uninterrupted or error-free internet connectivity.

The Hotel shall not be responsible for interruptions or failures outside its reasonable control, except where otherwise required by applicable law.

19 Personal Information

Personal information obtained in connection with reservations, guest registration, accommodation and related services shall be handled in accordance with applicable laws and the Company's Privacy Policy.

Guests should refer to the Privacy Policy for further information regarding the collection, use, disclosure, storage and other handling of personal information.

20 Force Majeure and Unavoidable Circumstances

The Hotel shall not be liable for failure or delay in performing its obligations where accommodation or related services cannot reasonably be provided due to circumstances beyond its reasonable control, including natural disasters, earthquakes, typhoons, fires, epidemics, government orders, acts of war or terrorism, widespread transportation disruption, utility failures or other comparable circumstances, except to the extent otherwise required by applicable law.

Where such circumstances materially affect a reservation, the Hotel will take reasonable steps to inform affected Guests and address the reservation in accordance with applicable laws and relevant booking conditions.

21 Changes to Reservations

Requests to change accommodation dates, room types, number of Guests or other reservation details are subject to availability and the conditions applicable to the original reservation.

Changes may result in a change to the accommodation rate.

The Hotel is not obligated to honor the original rate where the Guest changes the dates, room type, occupancy or other material conditions of the reservation.

22 Third-Party Reservations

Reservations made through an online travel agency, travel agent or other third-party booking service may also be subject to the terms and conditions of that third party.

Where payment has been made to a third party, cancellation, amendment or refund requests may be required to be processed through that third party.

Section L, Monograph Hotels and VOL. are not responsible for the operation, availability or independent terms and services of third-party booking platforms, except to the extent otherwise required by applicable law.

These Accommodation Terms shall continue to apply to the Guest's accommodation at the relevant Hotel notwithstanding that the reservation was made through a third party.

23 Special Requests

The Hotel will make reasonable efforts to accommodate special requests but cannot guarantee that all requests can be fulfilled.

Requests relating to room location, bedding configuration, early check-in, late check-out or other preferences are subject to availability unless expressly confirmed as part of the accommodation contract.

24 Safety and Emergencies

Guests shall comply with fire safety, evacuation and emergency instructions displayed at the Hotel or provided by Hotel employees.

Guests shall not tamper with smoke detectors, fire alarms, sprinklers, emergency equipment or other safety systems.

In an emergency, Guests shall follow instructions issued by Hotel employees, emergency services or other competent authorities.

25 Minors

Reservations and stays by minors shall be subject to the policies of the relevant Hotel and applicable Japanese law.

The Hotel may request consent or other documentation from a parent or legal guardian where reasonably necessary or required by the applicable Hotel's policy.

26 Amendments to these Terms

The Company may amend these Terms where reasonably necessary, subject to applicable laws and regulations.

The current version of these Terms shall be made available through the relevant website or other appropriate means.

Where required by applicable law, appropriate notice of material amendments shall be provided.

The terms applicable to an individual accommodation contract shall be determined in accordance with applicable law and the conditions presented in connection with the relevant reservation.

27 Governing Law and Jurisdiction
